  1. General
    1. Membership annual increase shall take effect on each 1 January annually regardless of the contract sign date. The increase amount is at the discretion of Body Action Gym management.
    2. Membership is on a month-to-month basis and will continue until cancellation is received in writing.
    3. Members are required to provide one full calendar month’s written notice to cancel their membership.
    4. Sufficient cause for cancellation of the agreement shall be in Body Action Gym's sole and exclusive discretion.
    5. We reserve absolute discretion when approving membership applications and reserve the right of entry onto the Body Action Gym’s premises.
    6. Upon damage being inflicted by the member to any such gym equipment, furniture, facilities, and/or fittings, Body Action Gym shall provide the Member with the replacement or repair costs quote to replace or repair.
    7. Complaints should be made to the Body Action Gym via email to info@bodyactiongym.co.za.
    8. Please take note that the facility might be disruptive when the members decide to jam to your favourite DJ spinning the decks.
    9. Wi-Fi will be available to all members, and the password may change from time to time. The new password will be available at reception.
  2. Membership Type
    1. Membership Type: Membership type refers to the specific category of membership that the Member has selected. Each Membership Type is governed by its own distinct set of terms and conditions, as specified below:
    2. Standard Membership: This Membership Type grants the Member access to the facility during the standard operating hours and days.
    3. Weekend Membership: This Membership Type permits access to the facility only on Saturdays and Sundays, during standard operating hours. Members holding a Weekend Membership shall not have access to the facility on weekdays or public holidays. Body Action Gym reserves the unequivocal right to refuse access to any Member holding a Weekend Membership who attempts to access the facility outside of the specified days and times.
    4. Membership types must remain consistent between main members and their dependants. Main members with a Standard Membership can only have dependants with a Standard Membership at subsidised rates, and main members with a Weekend Membership can only have dependants with a Weekend Membership at subsidized rates. Mixing different membership types between main members and dependants is not permitted.
  3. Membership Type Upgrades and Downgrades
    1. Members can upgrade their Weekend Membership to a Standard Membership before the 25th of each month.
    2. Upgrades must be completed before the next debit order date (the 1st of each month).
    3. Members must pay the pro rata balance of the monthly fee for the new Standard Membership at the time of upgrade.
    4. The cutoff date for upgrades is the 25th of each month, as we prepare for debit orders on this date.
    5. Upgrades will only take effect with the debit order run. Members requesting an upgrade after the 25th can only be processed after the 1st of the following month.
    6. The upgrade will bind the member to their original agreement, with the terms and conditions of the new membership type assumed.
    7. Members can downgrade their Standard Membership to a Weekend Membership before the 25th of each month.
    8. Downgrades requested after the 25th can only be processed after the debit order run on the 1st of the following month.
    9. Pro rata amounts for downgrades are non-refundable.
    10. The downgrade will bind the member to their original agreement, with the terms and conditions of the new membership type assumed.
    11. When upgrading or downgrading, both the main member and all dependants must be upgraded or downgraded together; mixed membership types are not permitted under a single contract.
    12. If a dependant member wishes to remain on a different membership type, they must enrol as a new main member with their chosen membership type.
  4. Non-Payment of the Membership
    1. Non-payment of your monthly membership fee will cause your access to Body Action Gym to be suspended, until such time when your membership fee is paid up to date via card payment at reception.
    2. Unpaid debit order will be re-debited should your debit order not go through.
    3. Should a member have 2 unpaid debit orders in a 12-month cycle, the gym has the right to terminate the membership.
    4. Should a member breach any terms of their agreement, they will be liable for all legal fees incurred by Body Action Gym.
    5. Should the Member’s monthly debit order and/or monthly payments come back as unpaid and/or returned, a set administration fee will be added on the invoice and/or invoices upon settling the unpaid invoice and/or invoices.
  5. Waiver and Release
    1. Body Action Gym will not be liable for death, injury, loss, or damage suffered by me through or contributing to by any cause whatsoever including but not limited to, any negligent (including gross negligent) act and/or omission or breach of contract on the part of the Gym, its directors, employees, contractors, independent consultants, or other members(s).
    2. The Gym premises will invariably be entered and exited (inclusive of the parking areas) entirely at my own risk and that the Gym equipment and facilities will, furthermore, be utilized on this very same basis. .
    3. The Gym would not be vicariously liable for any loss or damage suffered by me and/or other member(s) because of theft on the part of its employees, independent contractors, consultants, or other member(s).
    4. In the process of becoming a member of Body Action Gym, I and/or my estate, furthermore, indemnified the Gym against any claim by any person arising directly or indirectly from my death, injury, loss, or damage suffered by a member, allegedly caused or contributed to any act or omission by the Gym, its directors, employees, contractors, consultants and agents. .
  6. Disclaimer: Tanning Booth Use
    1. The use of the Monaco Solarium at Body Action Gym is subject to the following safety and operational guidelines. By using the tanning booth, you confirm that you have read, understood, and accepted these terms.
    2. Skin Type Assessment:
      • Determine your skin type (fair, dark, or in-between) and select an appropriate exposure time.
      • Members with fair or sensitive skin are advised to start with shorter sessions (e.g., 4 minutes).
    3. Usage Restrictions:
      • Only one tanning session is allowed per day.
      • Members may not exceed 52 tanning sessions per year. Exceeding this is done at your own risk.
      • Avoid combining tanning booth use with direct sunlight exposure; wait 48 hours between your first and second session.
    4. Health and Safety Precautions:
      • Eye Protection: Protective tanning goggles are mandatory and must be worn during sessions. Closing your eyes is not sufficient. Goggles are available for purchase at the Body Action Sportsgear Shop.
      • Cosmetics: Remove all cosmetics, especially products containing Alpha Hydroxy Acids, before tanning.
      • Hydration and Skin Care: Apply a moisturising and protective tanning cream before your session. These are available at Body Action Sportsgear Shop.
      • Medical Advisory: Do not use the tanning booth if you:
        • Are pregnant.
        • Are taking medication that causes photosensitivity (e.g., antibiotics, diuretics).
        • Have a family history of skin cancer or suffer from skin ailments.
    5. Potential Risks:
      • UV radiation may cause skin damage, premature ageing, and increase the risk of skin cancer.
      • Overexposure can result in redness, sunburn, or discomfort. Discontinue use immediately if these symptoms occur.
    6. Usage Policy:
      • Members under 18 years old or those with a history of severe sunburn, excessive freckles, or abnormal moles are not permitted to use the tanning booth.
    7. Liability Waiver: Body Action Gym is not responsible for health issues resulting from the use of the tanning booth. Use of the facility is strictly at your own risk. Body Action Gym assumes no liability for injuries, health conditions, or fatalities associated with tanning booth use.
  7. Disclaimer: Assessment Room Use
    1. The Assessment Room at Body Action Gym is equipped with advanced tools, including:
      • Technogym Checkup Machine
      • Blood Pressure Machine
    2. These tools are provided for informational and indicative purposes only and do not constitute medical advice, diagnosis, or treatment.
    3. Members are solely responsible for their health decisions and should consult a qualified medical professional for any medical concerns, diagnoses, or treatment plans.
    4. Body Action Gym and its staff are not responsible for any decisions made or actions taken based on the information obtained from the Assessment Room equipment.
    5. By using the Assessment Room, members:
      • Acknowledge that participation is at their own risk.
      • Accept full responsibility for their health, fitness, and well-being.
      • Agree that Body Action Gym, its staff, and affiliates are not liable for any injury, illness, or death resulting from the use of the room or its equipment.
    6. The Assessment Room door may be unlocked in emergencies or for rule enforcement purposes.
    7. Body Action Gym is not responsible for privacy breaches resulting from such actions.
    8. By entering and using the Assessment Room, members acknowledge and accept these terms in full.
  8. Mandela Day Plank Challenge Terms & Conditions
    1. Challenge Overview
      • The Mandela Day Plank Challenge is open to all Body Action Gym members and their guests on 18 July 2025.
      • Participants are encouraged to complete a 67-second plank in honour of Mandela Day and are welcome to attempt multiple planks. Multiple planks may be attempted in a single session only.
    2. How It Works
      • Each completed 67-second plank earns the participant one sticker, which will be placed on the designated challenge mirror by the stretching area.
      • Participants may complete multiple 67-second planks. Multiple planks may be attempted in a single session only. Multiple visits or attempts throughout the day will not be permitted.
      • A session is defined as a continuous plank effort conducted in a single session without leaving the gym premises. Once a session is completed, participants may not return later in the day for additional sessions.
      • Every sticker equates to R67, which Body Action Gym will donate to the SPCA.
      • Doubling the time to 134 seconds equals a R134 donation.
      • The member who holds the longest plank on the day will receive a complimentary smoothie from Kilojoule Café.
    3. Participant Guidelines
      • Participants must complete all plank attempts in one session under the supervision of a Floor Custodian. Returning later in the day to attempt additional planks is not permitted.
      • Floor Custodians are responsible for timing and documenting each plank attempt, including taking a photo of each participant with their sticker for social sharing.
    4. Donation Commitment
      • Body Action Gym will make the total donation to the SPCA based on the number of stickers accumulated during the event.
      • Members and guests are not required to contribute financially for their participation.
    5. Media Consent
      • By participating, all individuals consent to being photographed or filmed during the event. These images may be used for promotional purposes on Body Action Gym's digital platforms and media channels, including social media, website, and related marketing material.
    6. Safety Notice
      • Participants are encouraged to be in good health and physically capable of completing the challenge. Anyone with medical conditions or physical limitations should consult with a trainer or physiotherapist before participating.
      • Participation is voluntary and at your own risk. Body Action Gym is not liable for any injury, loss, or damage incurred during the challenge.
    7. General Terms
      • Body Action Gym reserves the right to amend or cancel the event or any of its components at any time without notice.
      • These terms form part of Body Action Gym's standard terms and conditions applicable to all members and guests.
  9. NPL Body Rev Challenge Terms & Conditions
    1. Campaign Duration:
      • The campaign runs from 25 August to 16 November 2025.
      • Registration takes place from 25 July – 22 August 2025.
    2. Eligibility:
      • The challenge is open to Body Action Gym members 18 years and older.
      • Participants must be active Body Action Gym members for the full duration of the campaign.
      • Employees of Body Action Gym may participate but are not eligible to win prizes.
      • Only Body Action Gym members who meet all participation requirements are eligible to win.
    3. Public Participation in Open Days:
      • To gain entry to an Open Day, non-members must show valid proof of registration for the NPL Body Rev Challenge, such as a confirmation email or screenshot from the NPL registration platform.
      • Access is subject to gym capacity limits and staff discretion.
    4. How to Participate
      • To qualify for leaderboard placement and prizes, participants must complete all the following:
        • Purchase 2 NPL Body Rev Challenge bundles/stacks at Body Action Sportsgear during the duration of the challenge.
        • Sign up via the NPL Body Rev Challenge website (external registration).
        • Complete a health assessment with the Wellness Coach using the Technogym Checkup at Body Action Gym.
        • Attend at least one (1) dedicated Body Rev Challenge class during the campaign.
        • Participate in weekly check-ins using the Health Check Kiosk and submit results on the Inner Circle Club system.
          • During their first health assessment with the Wellness Coach, participants will be taught how to:
            • Use the Health Check Kiosk
            • Upload their results on the Inner Circle Club System
        • Missing a weekly check-in submission disqualifies participants from prize eligibility.
        • Join the official WhatsApp group for daily motivation, accountability, and educational content.
    5. Winning and Prizes:
      • One male and one female Body Action Gym member will be selected as the winners based on:
      • Overall body transformation (as assessed from health assessments and weekly tracking).
      • Engagement and participation throughout the 12-week challenge.
      • Attendance at classes and check-ins.
      • Winners will be announced after 16 November 2025 and must be in good standing with the gym.
      • Prizes:
        • Male Winner:
          • Body Action Sportsgear Voucher – R2,500
          • KJ Voucher – R1,000
        • Female Winner:
          • Body Action Sportsgear Voucher – R2,500
          • KJ Voucher – R1,000
    6. Claiming Prizes:
      • Winners will be notified via the WhatsApp group and email by 23 November 2025.
      • Prizes must be collected in person at Body Action Gym reception within 14 days of notification.
      • Identification and proof of membership may be required upon collection.
    7. Additional Conditions:

      By entering this challenge, participants grant Body Action Gym the right to use:​

      • Photos and videos taken during the campaign (including classes, check-ins, and health assessments)
      • Social media content created and shared in connection with the challenge
      • For marketing and promotional purposes without further compensation.
      • Body Action Gym reserves the right to amend or cancel the campaign, challenge rules, or prizes at any time without prior notice.
      • All decisions regarding winner selection are final and no correspondence will be entered into.
      • Body Action Gym and its partners are not liable for any injury, loss, or damage arising from participation in the campaign or use of any prize.
      • Personal data collected will be processed strictly for the purpose of this campaign and handled in accordance with Body Action Gym's Privacy Policy.
    8. Privacy and Confidentiality of Health and Body Transformation Data
      • Body Action Gym respects and upholds the privacy of all participants with regard to sensitive personal information, including but not limited to weight, body composition, health assessment results, and any physical transformation data collected during the campaign.
      • By participating in this challenge, you acknowledge that such information will be collected solely for the purpose of monitoring progress and determining challenge outcomes. This data will be:
        • Handled confidentially and securely stored in accordance with Body Action Gym's Privacy Policy.
        • Accessed only by authorised Body Action Gym personnel directly involved in managing the challenge.
        • Not publicly disclosed in any identifiable manner without your explicit written consent.
      • Participants retain the right to opt out of any public sharing of their personal health or transformation data by providing written notice to Body Action Gym before the announcement of winners.
    9. Personal Training Discount Offer
      • Participants in the NPL Body Rev Challenge are eligible for a 30% discount on one personal training session per week during the 12-week challenge (25 August – 16 November 2025).
      • This discount offer is applicable only to sessions with the following Body Action Gym personal trainers:
        • Venae
        • Ts’epo
        • Shervantaigh
        • Monique
      • Only valid for new clients who have not previously trained with any of the above-listed personal trainers.
      • The offer is non-transferable and cannot be carried over to future weeks or used retroactively.
      • All sessions are subject to trainer availability and must be booked in advance.
      • This offer is designed to support participants in achieving their transformation goals with professional guidance and accountability.
